1. Acceptance

By creating an account or using Tradesman (“the Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of the Service

Tradesman is a business management platform for tradespeople. It provides AI-assisted quote and invoice generation, document management, and related tools. Features vary by subscription plan.

3. Accounts

• You must provide accurate information when creating an account.
• You are responsible for keeping your login credentials secure.
• You must be at least 18 years old to use the Service.
• One person or legal entity may not maintain more than one free account.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations.
• Submit false, misleading, or fraudulent information.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Reverse-engineer, scrape, or otherwise extract data from the Service.
• Resell or sublicense access to the Service without our written permission.

5. AI-generated content

The Service uses AI to help generate quotes, invoices, and other documents. AI-generated content may contain errors. You are solely responsible for reviewing, approving, and sending any document produced by the Service before it reaches a client. We make no warranty as to the accuracy, completeness, or fitness for purpose of AI-generated content.

6. Subscriptions and payment

• Paid plans are billed on a recurring basis through Paystack.
• All fees are non-refundable unless required by applicable law.
• We may change pricing with 30 days' notice. Continued use after the notice period constitutes acceptance of the new pricing.
• Failure to pay may result in suspension or downgrade of your account.

7. Your data

You retain ownership of all data you submit to the Service. By using the Service, you grant us a limited licence to process that data solely to provide and improve the Service. See our Privacy Policy for details.

8. Intellectual property

All software, design, and content comprising the Service (excluding your data) is owned by or licensed to us and protected by applicable intellectual property laws. Nothing in these Terms grants you a right to use our trademarks or branding.

9. Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

10. Limitation of liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total aggregate liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

You may close your account at any time from the Settings page. We may suspend or terminate your account if you breach these Terms or if continued operation poses a legal or security risk. Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Governing law

These Terms are governed by the laws of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.

13. Changes to these Terms

We may update these Terms from time to time. We will notify you by email or by posting a notice in the Service at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance.
